2/14/2023 Update: The Office of Federal Contract Compliance Programs (OFCCP) is giving employers more time to submit corrections to the agency’s list of companies whose EEO-1 data will be publicly released. Explaining that greater quality assurance is needed, the agency announced the following:
- The time for employers to object to the release of information is extended from February 17, 2023, to March 3, 2023.
- The agency will post an updated list of what it refers to as ‘non-objectors’ (i.e., companies whose information will be released) no later than February 17, 2023. The updated list deletes contractors that OFCCP has identified as incorrectly included on the February 2, 2023 list.
- After the close of the new response period on March 3, 2023, OFCCP will publish a second updated contractor list by March 10, 2023, which will remove contractors that submitted objections after February 10, 2023 and by March 3, 2023, while OFCCP evaluates these objections.
- Contractors will then have one final opportunity to contact OFCCP no later than March 17, 2023, if they believe their company was improperly listed.

The agency’s release of federal contractor workforce demographic information from EEO-1 filings of private companies for the years 2016 through 2020 is triggered by a Freedom of Information Act (FOIA) request. For more details on the information to be released, see our postings from February 5, 2023, Employers Have Until Midnight February 7th to Correct Errors Before Public Release of EEO-1 Data and from August 19, 2022, September 19th Deadline for Contractors to Object to Public Release of EEO-1 Data.
