The U.S. Department of Labor (DOL) reports that they are finding many wage and hour violations in their investigations of home care companies. According to the agency, it finds violations of federal wage law in 80 percent of their investigations of the home care employers. Since 2021, the agency has recovered more than $28.6 million in back wages and penalties for nearly 25,000 workers. In the same period, employers were assessed close to $1.3 million in civil penalties. Common violations include failure to pay for overtime and travel time, misclassification of employees as independent contractors, and inadequate recordkeeping.
To address the high rate of industry wage violations, the DOL is offering a webinar for home care employers and workers. The webinar will cover worker rights and employer obligations, with an emphasis on the issues most often associated with violations of the Fair Labor Standards Act.
The DOL Wage and Hour Division will provide the training on May 4, 2023 from 2 to 3:30 p.m. CDT. The webinar is free, but registration is required.
